Banner Life Insurance Company (Banner) filed for a declaratory judgment in the United States District Court for the Eastern District of Virginia seeking to limit its obligations under a binder of temporary insurance entered into with Gary Noel. Jacqueline Noel, the beneficiary of the policy, opposed the action and filed a counterclaim for breach of contract.
