The question for decision in this case is: “Who is the owner of the tract of land in controversy, the complainant, C. L. Anderson, or the defendants, Robertson and Walker? The facts necessary to be stated are as follows: T. A. Stribling was the owner of a tract of land in Hickman county containing two hundred and seventy-four acres. This tract of land was incumbered by a mortgage to J. A. Bates to secure a note owing by Stribling to Bates for $1,009, which note was past due.
