Appeal from City Court of Birmingham. Tried before the Hon. H. A. Sharpe. This was an action on the case brought by the appellee against the appellant; and sought to recover damages for personal injuries alleged to have been suffered by the plaintiff through the negligence of the defendant or its employes, while the plaintiff was in the employ of the defendant as an engineer. The complaint originally contained but one count; but two others were added by way of amendment.
