LOWELL, District Judge.
The steamer Iris was the property of Mr. Woodworth, the claimant, and her home port was Boston. Having been laid up for several years, she was greatly out of repair, both as to her hull and her machinery. On December 23, 1897, Woodworth agreed to sell her to the North American Mining & Transportation Company. A part payment of S¡>1,000 was made at the time the agreement was signed, and the balance of the purchase money, $6,000, was to be paid on or before February 21, 1898.
