The Postal Telegraph Cable Company, the appellant, is a corporation organized under the laws of Delaware. It aocepted the advantages and obligations, of the Act of Congress, approved July 24, 1866, * entitled “An Act to aid in the construction of telegraph lines, and to secure to the government the use of the same for postal, military and other purposes.” It has been held that whilst the companies accepting the provisions of that Act may use the post-roads of the country, the Act was not intended to interfere with State sovereignty under the Constitution.
