Myrta E. Hunn, a teacher in the employ of the board of education of the city of Batavia and a member of the New York State Teachers’ Retirement System (hereinafter called the System) *189was committed on July 25, 1940, to the Rochester State Hospital by order of the county judge of Genesee county, pursuant to the provisions of section 74 of the Mental Hygiene Law. On August 7, 1940, her brother, Roy E. Hunn, signed and filed with the System’s Retirement Board an application for her retirement on account of disability.
