GRAVES, Justice.

Upon a jury’s verdict on special issues, as well as upon its own conclusions upon the law and evidence, the trial court gave the appellee a $1,620 judgment against the appellant, pursuant to a certificate or contract of insurance that had been extant between them since the date of its issuance on May 10 of 1928, $1,000 of it being for the total disability indemnity provided for in the contract, the remaining $620 being for the 12 per cent, penalty and reasonable attorney’s fees provided for in R.S. art. 4736, as amended by Acts 1931, c. 91, § 1 (Vernon’s Ann.Civ.St. art.…
