The plaintiff bank brought this action in the usual and ordinary way on two notes against the two makers thereof, being son and father. The indebtedness to the bank was entirely that of the son. The only defense made was by the father, although *935the son was duly served and was a witness in the case. The answer of the father was on two separate grounds: duress and the illegality of the consideration, alleging in detail the threat made by the officers and agents of the bank to prosecute the son for making false representations to the bank…
