The plaintiff-in-error, defendant, was found guilty of an assault with intent to commit voluntary manslaughter and sentenced to serve two years in the State Penitentiary. A motion for a new trial was seasonably made, and overruled. The defendant has appealed and has assigned as error: — (1) The refusal of the Trial Court to grant a new trial on the ground that the evidence preponderates against the verdict found against the plaintiff-in-error and in favor of his innocence.
