The appellant and respondent were candidates for the office of commissioner in the city of Sioux Falls, S. D., at an election held in said city on the 28th day of April, 1936. On May 1st, 1936, the official canvassing board canvassed the election returns and declared that respondent had been elected and issued a certificate of election to him.
