The plaintiff is a corporation organized in 1881, under the provisions of chapter 84, 1 How. Stat. It has maintained its organization since that time, and has built and continuously operated a system of waterworks since its organization in the defendant city. The defendant city was first incorporated in the year 1873, *482under a special charter, received a new charter in 1893, and passed under the general law of 1895, by taking no' action after that act went into operation.
