Defendant-Appellant Nobryan McGee (“McGee”) pleaded guilty to one count of failing to register as a convicted sex of fender in violation of the Sex Offender Registration and Notification act (“SOR-NA” or “the Act”), 18 U.S.C. § 2250(a). 1 The district court upwardly varied from the United States Sentencing Guidelines (“Guidelines”) in sentencing McGee to 84 months of imprisonment, to be followed by a lifetime term of supervised release.
