Defendant was indicted for having on June 1st, 1922, upon one Anna Sigismondi, a woman-child under the age of sixteen years, to wit, thirteen years, made an assault, and then and there did unlawfully carnally abuse her, said Nicholas Yanetti being then and there over the age of sixteen years, to wit, of the age of forty-six years. The defendant pleaded not g"uiltjr, and, upon this issue of traverse joined between the state and him, was tried by a jury in the Passaic Quarter Sessions and convicted.
