I have read, and re-read, and re-re-read, the majority’s opinion. I don’t know what was in the Kool-Aid they were drinking, but I believe that the opinion is one of the most factually misleading and legally pernicious cases to be produced by this Court.

Make no mistake — -a West Virginia jury heard from all the witnesses for both sides, and decided that West Virginia University Hospitals (“WVUH”) failed to provide Allison Riggs with a safe, sermtia-ivee environment. Ms. Riggs is the daughter of Dr. Jack E. Riggs, a physician who works at WVUH. She was only fourteen when…
