Ed Keller was convicted of the crime of engaging in the liquor traffic. Thereafter he moved for' a new trial. The motion was denied. This appeal is from the judgment of conviction and from the order denying his motion.

While the appeal is from both the judgment and the order denying his motion for a new trial, the only question raised here is as to the propriety of the order. The motion for new trial was made on the minutes of the court and the affidavit of Keller. The state made no counter-showing.
