OPINION
KOCH, Judge.
This appeal arises from a dispute between the developer of a planned unit development located in an affluent section of Nashville and the development’s homeowners. In 1979, the non-profit corporation consisting of the development’s homeowners together with several individual owners brought an action in the Chancery Court for Davidson County against the developer and the Metropolitan Government of Nashville and Davidson County claiming that the development was being damaged by an inadequate surface water drainage system.
