—In an action to recover damages for personal injuries, etc., the plaintiffs appeal from an order of the Supreme Court, Nassau County (O’Brien, J.), dated April 1, 1997, which granted the motion of the defendants American Ref-Fuel Company of Hempstead and Town of Hempstead Industrial Development Agency for summary judgment dismissing the complaint insofar as asserted against them.

Ordered that the order is modified by deleting the provision thereof which granted that branch of the motion which was for summary judgment dismissing the cause of action based upon Labor Law § 241 (6) insofar as…
