MEMORANDUM OPINION

FRANK R. MONROE, Bankruptcy Judge.

This court held a hearing on May 16, 2006 on the United States Trustee’s Motion to Dismiss Case Pursuant to 11 U.S.C. § 707(b)(1), (b)(2), and (b)(3). This Court has jurisdiction under 28 U.S.C. § 1334(a), (b) and (d), 28 U.S.C. § 151, 28 U.S.C. § 157(a) and (b)(1), and the Standing Order of Reference in this District. This is a core proceeding under 28 U.S.C. § 157(b)(2)(A) as this is a motion to dismiss Daniel Keith Oliver’s (“Debtor”) bankruptcy proceeding pursuant to certain provisions of § 707 of the Bankruptcy Code.
