In satisfaction of a three-count indictment, defendant pleaded guilty to driving while intoxicated. Under the terms of the plea agreement, defendant was given the option of participating in Chemung County Drug Court, which would result in a sentence of five years of probation if he successfully completed it or a prison term of 2 to 6 years if he did not successfully complete it.
