Kimball, Chief Justice.

The plaintiff, Mike Ura.m, alleges that he is unlawfully confined in the state penitentiary and applies for a writ of habeas corpus. A similar previous application to the judge of the second district court has been denied.

The warden as defendant has filed his answer to which plaintiff demurs, but the parties evidently desire a decision on the facts that are shown by a written stipulation.
