The appellant herein is the executrix of the last will and testa- • ment of Augustus Deyoe, who met his death on the 3d day of March, 1917, while driving along the public highway to his home from the village of Schuylerville. He had a horse and light cutter. He was last seen about eleven o’clock in the evening of March second, when he took his horse from a stable where it had been prior to leaving for his home.
