Inasmuch as both the petition of plaintiff Earl Taylor, as plaintiff and W. P. Phillips, Jr., as intervener are substantially the same, reference will be made hereinafter to them as plaintiffs and the parties will be referred to as they appeared in the lower court. The principal allegations of the petition being that the defendant B. B. & G.
