MEMORANDUM AND DECISION
GERTNER, District Judge.
This is a diversity action stemming from a plane accident in which both passenger and pilot were killed. The executrix of the passenger’s estate, Florine Mullins (hereinafter “Muhins”), suing on behalf of the estate of her husband, William H.L. Muhins, brings this wrongful death action against the executor of the phot’s estate, Robert Garthwait (hereinafter “Garthwait”), defending on behalf of the estate of George F. Enhorning.
