Plaintiffs Alpha Capital Anstalt (“Alpha Capital”) and Osher Capital Partners, LLC (“Osher,”)(collectively, “Plaintiffs”) brought this action against defendants Ox-ysure Systems, Inc. (“Oxysure”) and Julian Ross (“Ross”) (collectively, “Defendants”), alleging that Defendants breached the terms of the Securities Purchase Agreement (“SPA,” Dkt. No. 75-1) entered into by the parties.
