As shown by the assessment rolls in the office of the county commissioners for the year 1900, the land of the defendant was assessed as seated land. It was improperly returned as unseated land, placed on the unseated land tax return and sold as unseated land, the treasurer’s deed reciting that it was unseated. We cannot agree with the learned trial judge, that there was merely a clerical mistake made by the collector.
