I. INTRODUCTION
Before the Court is a “Motion to Dismiss and Memorandum of Law in Support of Motion to Dismiss and Opposition to Request for Injunctive Relief’ (“Mot. to Dismiss”) (Docket No. 5) filed on April 1, 2002. The complaint in this case was' originally filed in the Court of First Instance of the Commonwealth of Puerto Rico, Fa-jardo Part, on Thursday, March 21, 2002.
