WEXLER, District Judge.

Life Industries Corporation (“plaintiff”), filed suit against Ocean Bio-Chem, Inc. and its wholly owned subsidiary, Starbrite Distributing, Inc. (“Starbrite”) (collectively “defendants”), for infringement of plaintiff’s rights arising under the Federal Trademark Act of 1946, 15 U.S.C. § 1051 et seq., commonly known as the Lanham Act. Specifically, this action arises under §§ 34, 35 and 43(a) of the Act (15 U.S.C. §§ 1116, 1117, 1125(a)).
