MEMORANDUM AND ORDER

In this action for equitable indemnity, defendant has moved the Court for dismissal of the complaint, Fed. R. Civ. P. 12(b)(1) or, in the alternative, for summary judgment. Fed. R. Civ. P. 56.

I. PROCEDURAL BACKGROUND

Plaintiffs seek to recover from defendant the sum of $264,000.00 which they paid in 1979 in satisfaction of a judgment entered in a separate personal injury action. Lentz v. Kopenski, Civ.
