In this case, the Chapter 7 Trustee seeks approval of his statutory compensation calculated pursuant to 11 U.S.C. § 326. The particular issue presented is whether the trustee is entitled to statutory compensation based upon funds distributed to administrative claimants in view of the Testaverde and Stein decisions recently rendered by the United States District Court for the Eastern District of New York.
