I agree with the plurality that plaintiff Paramount Pictures Corporation (Paramount), is barred by res judicata from pursuing a claim for attorneys' fees based on defendants' alleged breach of a covenant not to sue, because ***81Paramount failed to assert this as a counterclaim in defendants' prior federal lawsuit against Paramount.
