FORD, District Judge.

This cause came on before me on August 4, 1941, on an order to show cause why a preliminary injunction should not issue to restrain the defendant from infringing United States Patent No. 1,544,172, issued June 30, 1925, which is the subject of the suit. The case was heard upon the verified complaint, exhibits attached thereto, affidavits and counter affidavits filed by the parties.
