MEMORANDUM OPINION and ORDER

LARKINS, District Judge:

This is a petition for a writ of habeas corpus pursuant to 28 U.S.C. Sec. 2254, in which petitioner John F. Manning, presently incarcerated at the Polk Youth Centex’, Raleigh, North Carolina, claims that he is being detained in violation of his l’ights under the Constitution of the United States.

Petitioner, having entered a plea of guilty to the offence of felonious breaking and entering and the misdemeanor offence of lax’ceny which are violations of the North Carolina General Statutes, was sentenced the 26th day of January, 1973 to be…
