WILLIAM E. GLADSTONE, Circuit Judge.
This cause came on for final hearing on October 1, 1973. Prior to final hearing the respondent filed a motion to designate the standard of proof and a motion to dismiss this cause, and the court, having heard the arguments of counsel for both the petitioner and the respondent and having reviewed the memoranda of law filed herein, indicated that both motions would be denied.
