This is an action upon an express contract to recover $3040 for commission alleged to be due' the plaintiff as agent or broker for the sale of certain real estate owned by the defendant. Verdict and judgment being in favor of the plaintiff, the defendant has appealed.
The defendant answered by a general denial. Defendant subsequently amended his answer by alleging that on or about the 1st day of August, 1901, plaintiff and defendant entered into a contract relating to the sale of 19 quarter sections of land, in words and figures as follows: “Verdón, S.
