HENRY, Associate Justice.

This suit is with regard to the title of a survey containing six hundred and forty acres of land lying in Brown County, Texas, patented to Greenberry Logan in the year 1853. Logan died in the year 1864, leaving surviving him his wife Caroline Logan his sole heir.

Plaintiffs claim under a deed made by Caroline Logan and W. A. and M. J. Taylor to Harwood & Winston, dated the 10th day of October, 1877, which was in all respects sufficient to convey the title if she then owned it.
