JACKSON, District Judge.

This is an action of debt, founded upon a penal bond executed by the defendant company as principal, and five securities, who, by the-condition of the bond, become responsible for the payment by the defendant company to the plaintiff of a certain license fee or royalty for the use of certain machinen, as it appears from a contract entered into between tire parlies on the 22d day of November, 389-, which is attached and referred to in the bond, and made part of it.
