This suit was brought by W. P. Moore, H. L. Hunt, trustee, and N. G. Landrum, as plaintiffs, in the district court of Rusk county, Tex., on May 28, 1931, against the heirs and unknown heirs of Jediah Blackwell, deceased. Service was had on all defendants by publication. On January 21, 1932, plaintiffs filed their third amended petition, upon which they went to trial. In their third amended petition, plaintiffs alleged that they were the owners in fee of 82.68 acres of land, fully described in the amended petition; alleged the usual counts in trespass to try title, and therein pleaded the two,…
