ANDERSON, Circuit Judge:

We must determine in this appeal whether a bankruptcy court can look behind a prior consent judgment and whether there are genuine issues of material fact with respect to actual or constructive fraud against creditors. Plaintiff-Appellant Donald Dionne (“Trustee”) is the trustee for the bankruptcy estate of XYZ Options, Inc. (“XYZ”). The Trustee sued Defendants-Appellees, Scott M. Spangler, Jean G.
