dissenting from Part 11(A)(1):

The six years of debate in the Texas Legislature before voter ID passed dera-*329onstrates that it is a controversial political question. The opinions issued today demonstrate it also raises contentious legal questions. And with respect to how to assess vote denial (as opposed to vote dilution) claims under the “effects” test of the Voting Rights Act, it is a difficult one.
