The third plea interposed the defence that the failure of the county board to remove Sieber from office, because of his default in making his report to that board at its December term, 1878, relieved the sureties from liability for breaches of the bond occurring subsequent to that time. The circuit court, by sustaining a demurrer to the plea, adjudged the defence invalid, and such was also necessarily the ruling of the Appellate Court in affirming the judgment of ■ the circuit court.
