Appeal from special term, Kings county. Actions by Fred Adee against the Nassau Electric Railroad Company and another, and Florence Adele Lott and another against the same. From judgments in favor of the plaintiffs, defendants-appeal.

The plaintiffs are the owners of two lots outlie southerly side of Union street, Brooklyn, together with the fee-of the land lying in the street in front of their premises to the-center thereof. Union street is a public street of the city, but the city has only an easement therein, never having condemned the fee of the street. The defendants are about to construct a street-surface electric railroad in Union street and upon the land of the plaintiffs, without having taken condemnation proceedings to acquire the title of the plaintiffs or obtaining their consent or compensating them.
