BELCHER, Judge.

The conviction is for assault with intent to murder; the punishment, seven years in the penitentiary.

The assaulted party testified that while he was seated in a cafe the appellant asked him to come to where he was as he wanted to talk to him. When the .assaulted party approached, the appellant said, “You been talking about me,” which was denied, then the appellant drew a pistol from his clothing and, as the assaulted party ran through the door going into the kitchen, appellant shot him below the left shoulder in the back.
