Error to Wayne; Dingeman (Harry J.), J. Case by Hugh G. Jones, an infant, by his next friend, against the Detroit Taxicab & Transfer Company for personal injuries. Judgment for plaintiff. Defendant brings error. Plaintiff, 4 years and 4 months old, was struck by a' taxicab in the street in front of his parents' home, No. 71 Marantette street, in the city of Detroit. He was carried into the house, hurried to a hospital, where he remained some time.

It is first insisted that the witness Miller had not qualified himself to testify on the subject of the speed of the taxicab and it is urged that, his testimony being the only testimony offered by the plaintiff on the subject of speed, there was no competent testimony that the taxicab was éxceeding the statutory rate, and a verdict should have been directed for the defendant.
