Appellant, Carlton Wood, was found guilty of evading arrest and the trial court found that the enhancement alleged in the indictment was “true.” Appellant was sentenced to four years’ imprisonment. He appealed, arguing that there was no basis for the trial court’s finding that the enhancement paragraph was “true.” The court of appeals held that the State failed to prove the conviction used for enhancement.
