The matter before the Court is Plaintiffs Motion for Partial Summary Judgment on the Writ of Mandate Claim. (ECF No. 112).

On September 2, 2011, Plaintiff Academy of Our Lady of Peace (“OLP”) filed a First Amended Complaint against Defendant City of San Diego (“City”). (ECF No. 109).
