Appellant James F. Tabor (“Defendant”), was charged with statutory rape in the first degree for having sexual intercourse with his niece, A.M., who was less than fourteen years old, in violation of § 566.032. 1 He was found guilty by a jury and sentenced by the court to thirty years’ imprisonment.
