INTRODUCTION
Plaintiff Sea Gate Beach Olub Corporation brings claims under the Federal Tort Claims Act (“FTCA”), 28 U.S.C. §§ 1346(b), 2401(b), 2671-2680 (2006), for trespa'ss and nuisance against the United States Army Corps of Engineers (“USACE”). .Plaintiffs claims arise from the construction incident to the Coney Island shoreline reconstruction project, which closed the beach for all recreational activity.
