The testator, Joseph Auditore, died in May, 1920. His widow, Guisippina Auditore, now Guisippina Tarascándola, and Frank Auditore, his brother, were appointed administrators with the will annexed of the goods, chattels and credits of the decedent. Frank Auditore violated the trust confided in him. He was removed as administrator. He and the surety upon his bond, as administrator, were held responsible for the loss caused to the estate by his breach of trust. (Matter of Auditore, 249 N. Y. 335.) The appellants John J.
