This is an appeal from a judgment of the District Court of the United States for the Eastern District of Virginia, entered on June 30, 1939, in an action in which the appellee, Mrs. Viola Fulmer, here referred to as the plaintiff, was plaintiff, and the appellant, Southern Fruit Distributors, Incorporated, of Winter Gardens, Florida, here referred to as the defendant, was the defendant.
