The defendant was charged with the murder of one Robert Heflin. He was convicted of murder in the second degree. His motion for a new trial was denied, and he appeals from the judgment and order.
The homicide was committed in Nogales, on a moonlight night, about 11 o’clock, in the month of February, 1915. The defendant is a negro soldier, and one of a troop of United States cavalry stationed on the border at Nogales.
